Terms of Services

1. Services

Enfocado Fotografía provides professional photography services for private and commercial clients. Services include, but are not limited to, real estate photography, interior and commercial photography, school photography, and family or lifestyle sessions.

Services include photography, post-production, image editing, and digital delivery of final images, unless otherwise agreed in writing. The specific services, deliverables, and pricing are defined in the agreed quotation or booking confirmation.

2. Booking & Confirmation

• A booking is confirmed once the client accepts the quotation and a date is agreed.

• By confirming a booking, the client accepts these Terms of Service.

3. Pricing & Payment

• Prices are agreed in advance.

• Payment is due within the period stated on the invoice.

• Final delivery of photos will take place after the payment has been recieved.

4. Delivery

• Images are delivered digitally.

• RAW or unedited images are not delivered, unless agreed in advance.

5. Cancellations & Rescheduling

• Clients may reschedule until 48 hours before the agreed date and time.

• Late cancellations or no-shows may be charged.

• If a session cannot take place due to weather, safety, or circumstances beyond control, it will be rescheduled.

6. Image Usage Rights

• After full payment, the client receives a non-exclusive license to use the images for their intended purpose.

• Images may not be sold, transferred, used commercially (outside of their intended purpose), or used by third parties without permission.

• Enfocado Fotografía retains copyright to all images.

7. Portfolio Use

• Unless otherwise agreed, Enfocado Fotografía may use images for portfolio, website, and promotional purposes.

8. Liability

• Every effort is made to provide high-quality results.

• The photographer is not liable for:

  • missed shots due to property condition

  • restrictions beyond control

  • indirect damages or lost business opportunities

• Liability is limited to the amount paid for the service.

9. Governing Law

• These terms are governed by Spanish law.

Service-Specific Conditions

These additional terms apply only when relevant to the booked service.

11. Property & Commercial Photography

• The client is responsible for preparing the location before the session, unless otherwise agreed. This includes cleaning, decluttering and staging.

• The client is required to indicate specific wishes before confirmation of the booking.

• If the location is not ready, the session may proceed as is, or be rescheduled with an additional fee.

• Travel costs may apply for locations outside 75 km from Gandia.

• Drone photography depends on legal permission and safe conditions.

• The client must ensure safe and complete access to the entire property.

• The client must be present for the duration of the shoot.

12. School Photography

• The school or client is responsible for obtaining parental consent where required.

• Image delivery and distribution are organized in agreement with the school.

13. Family & Lifestyle photography

• Session details (duration, location, number of images) are agreed in advance.

• If participants arrive late, session time may be reduced, or extended if possible at an additional fee.

• Under age children must be accompanied by a responsible adult.

• A typical session is shot at one location, unless otherwise agreed.

10. Changes & updates

• Enfocado Fotografía may update these Terms of Service from time to time.

• The version in effect at the time of booking applies to the agreed service.

• The latest version is always available on this website.
